Version of 27 October 2026. In case of discrepancy, the French version prevails.
These terms (the "Terms") govern the use of the Colissimo Officiel app for Shopify (the "App"), published by BT CONSULTING – LE STUDIO DE TOM (the "Publisher"), by any Shopify store that installs it (the "Merchant").
Installing the App means accepting the Terms. They are intended for businesses only.
The App lets the Merchant sync Shopify orders, generate Colissimo labels, customs declarations (CN23) and deposit slips, track parcels, manage returns and offer pickup points at checkout.
Labels are generated through La Poste – Colissimo web services, using the Merchant's own Colissimo contract and credentials. Parcel transport is governed solely by that contract, between the Merchant and La Poste.
Plans and prices are shown on the App's Shopify App Store listing and in the App. They are billed by Shopify, on the Merchant's Shopify invoice, once the Merchant approves them in the Shopify admin.
The Merchant may change plan or end the subscription at any time by uninstalling the App. A period already started is not refunded.
Prices do not include La Poste services (postage, options, duties and taxes).
The Merchant:
The Publisher uses reasonable means to keep the App available. It does not guarantee uninterrupted or error-free operation, in particular during maintenance or when Shopify or Colissimo web services are unavailable.
Support is available from the App or at contact@lestudiodetom.com.
6.1. The Publisher is bound by an obligation of means (best efforts).
6.2. The Publisher guarantees no delivery time. It is not liable for the acts of third parties, including:
Nor is the Publisher liable for customs formalities, duties or penalties.
6.3. The Publisher is not liable for indirect damages: loss of revenue, margin, customers, orders, reputation or data.
6.4. In any event, the Publisher's total liability is limited to the amount, excluding tax, paid by the Merchant for the App during the twelve (12) months before the event giving rise to the claim.
6.5. These limits do not apply to gross negligence or wilful misconduct, or where the law prohibits limiting liability. They reflect an allocation of risk between businesses, reflected in the App's price.
For the Merchant's customers' data, the Merchant is the controller and the Publisher acts as processor, on its behalf and on its instructions, within the meaning of Article 28 GDPR. The Publisher does not sell this data and does not use it to train artificial intelligence.
The data processed, sub-processors, retention periods and the Publisher's anonymous statistics are described in the privacy policy. A detailed data processing agreement is available on request.
The App, its code and content remain the Publisher's property. The Merchant has a personal, non-exclusive right to use it for the duration of its subscription. The Merchant's data remains its property.
The Publisher may suspend access in case of non-payment reported by Shopify, a security threat or use contrary to the Terms.
The Merchant can retrieve its data using the App's exports before uninstalling it.
The Publisher may update the Terms. The Merchant is informed in the App or by email at least 30 days before they take effect; if it disagrees, it may uninstall the App.
The Terms are governed by French law. Failing an amicable settlement, any dispute is brought before the Commercial Court of La Roche-sur-Yon (France).
